Please make sure to read through all the Terms and Conditions as set out below before placing your order. By using our website and/or any services offered here, you agree to accept and abide by these Terms and Conditions.

These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Thornewood Treasures (“Provider”) website located at the domain name www.thornewoodtreasures.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for marketing and other purposes without the consent of the Provider.

PRODUCTS

All the products on this Website are made by hand and therefore slight differences may occur. Wood naturally have colour variations and may contain knots or other natural markings. Thornewood Treasures views these as part of the charm and attraction of natural wood and therefore it can be expected to be present in many of the products. The colour of natural, unpainted wood products may differ from those in the photographs as wood come in many variations of natural colour.

All products manufactured by Thornewood Treasures are made to the highest standards and are inspected for quality before delivery Should a product be delivered broken or damaged, please refer to our RETURNS POLICY.

Thornewood Treasures cannot be held liable for any injury/death/ or any other loss that may occur directly or indirectly from the use of our products as they are used outside of our control. Thornewood Treasures assume no obligations or responsibilities whatsoever. The purchaser or user indemnifies and holds Thornewood Treasures harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

ORDERS AND DELIVERY

Thornewood Treasures currently only delivers to addresses in the Republic of South Africa.

Only courier delivery is available. No deliveries through the SAPO.

Orders placed on the Website are binding and cannot be cancelled.

All products are made to order. The User agrees to accept the delivery time of 3-4 weeks from the date on which the order was placed. The Thornewood Treasures team will always attempt to dispatch an order well before the 3-4 weeks IF POSSIBLE.

Thornewood Treasures reserves the right to cancel an order for any reason whatsoever on notice to the User. In such cases, if payment has already been made, the User will be fully refunded.

Thornewood Treasures will not be held liable for any damage or loss incurred due to incorrect delivery address or contact details provided by the User.

The User accepts that in order for Thornewood Treasures to prove delivery of an order or part of an order, Thornewood Treasures do not have to prove that the User personally received the goods, but that any person at the delivery address specified on the order signed for the delivery.

Damaged parcels: It is the responsibility of the User to make sure that parcels are inspected upon delivery. The User has the right to refuse parcels that are obviously opened or damaged. The User has the right to open the parcel in front of the courier to check if the contents are in good condition before signing for receipt. Please inform Thornewood Treasures immediately of any damages. Once the User signs for receipt of the parcel, the responsibility for the parcel shifts to the User.

SHIPPING AND DELIVERY

Every product on the Thornewood Treasures website is made to order with much love and care. There is therefore a delivery time of 3-4 weeks from the date on which the order was placed. The Thornewood Treasures team will always attempt to dispatch an order well before the 3-4 weeks IF POSSIBLE and you will be notified via email as soon as your order has been dispatched. We will also send you the waybill number to use for tracking your parcel on the couriers’ website.

COLLECTIONS – FREE

Customers in the Northern suburbs of Cape Town or in our hometown of Malmesbury are welcome to collect their orders in person.

Please choose ‘Collect in Durbanville’ or ‘Collect in Malmesbury’ at checkout. We will send you the directions and address for collections via email.

COURIER

We offer door-to-door courier service via The Courier Guy.

• Orders under R2000 : R99 per order, delivered to your door
• Orders over R2000: Free courier to your door.

Please note that Thornewood Treasures currently only deliver to addresses in the Republic of South Africa.

All our toys leave our workshop only after careful inspection.

REFUNDS AND/OR RETURNS

Orders placed on the Website are binding and cannot be cancelled.

RETURNS

Should the User not be completely satisfied, they may return their order to Thornewood Treasures within 5 days and qualify for an online shop credit. No cash refunds. The User shall ensure that the product is returned undamaged and in its original packaging, and the User will be responsible for the cost of return shipping. Please contact returns@thornewoodtreasures.co.za if you choose to return a product.

To qualify for a return and shop credit, your item must be unused and in the same condition that you received it.

Preparing your products for a return

When returning any product, it is your responsibility to:

• Package your products safely and securely for protection during transit.
• Please make sure to include all items and or parts of items. This is    especially important in the case of products sold in sets.

CUSTOM ORDERS AND CLEARANCE STOCK

Custom orders may not be cancelled, returned or refunded.  Clearance stock will not be returned or refunded.

INCORRECT ORDERS

In the rare event that we sent you the wrong product, please notify Thornewood Treasures within 4 days of receiving it. We will arrange for collection of the incorrect stock and dispatch the correct stock thereafter.

DAMAGED PARCELS

It is the customer’s responsibility to make sure that parcels are inspected upon delivery. You have the right to refuse parcels that are obviously opened or damaged, and you may open the parcel in front of the courier to check if the contents are in good condition before signing for receipt. Please inform Thornewood Treasures immediately of any damages. Once you have signed for receipt of the parcel, the responsibility for the parcel shifts to the you.

OTHER DAMAGE

Please use good sense in the care and keeping of your handmade wooden toys. Our toys are made to be play with, but although wood is a naturally strong material, it is not unbreakable and is subject to wear and tear. Paint may chip or scuff and wood may crack or break. All Thornewood Treasures toys are made to the highest standard of quality and care, but rough play, natural wear and tear and negligence may all result in damage and we will not be replacing anything that has been dropped, banged, scratched or otherwise damaged. Individual rainbow arches and flame stacker arches can unfortunately not be replaced as all rainbows and flames are cut as a single unit.

ONLINE PAYMENT

All online credit card payments and SID instant EFT Payments are processed by PayFast Online Payment Services.  Please visit www.payfast.co.za to view their security policy.

PRIVACY POLICY

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information (that is the delivery address and contact phone number) will be made known to third parties delivering the product.  Credit card details are not kept by the Provider under any circumstances.

E-COMMERCE WEBSITE CONTENT & PRIVACY

The Website www.thornewoodtreasures.co.za sells handmade children’s toys and learning materials.  The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser or user indemnifies and holds Thornewood Treasures harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

Thornewood Treasures does not accept any responsibility for any faults, errors or interruptions that may occur from using this site. Thornewood Treasures does not accept any responsibility either for any computer viruses your device may have contracted whilst using this site. This site is provided “as is” and you use it at your own risk. Thornewood Treasures accepts no liability for any loss or damage resulting from any use of this site or any of its content, howsoever such loss or damage may result. Thornewood Treasures makes no representations or warranties of any kind, whether express or implied. Thornewood Treasures disclaims all representations and warranties including, but not limited to, the site and its availability, the content of the site or the accuracy thereof, product availability and delivery times, merchantability or fitness for a particular purpose of information, goods or services.

Thornewood Treasures cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Thornewood Treasures will supply all goods to the delivery company in good order. Thornewood Treasures will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

UPDATES TO TERMS AND CONDITIONS

Thornewood Treasures reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will take effect within 24 hours after such changes are posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.  When placing an order, the agreement in force at the time of your placing the order will apply to that order and its related transactions.
